General Terms of Use · Kukuruchi Browser Game

1. Scope and Acceptance

These Terms and Conditions ("Terms") govern your access to and use of the website kukuruchi.com and the browser-based game Kukuruchi (collectively, the "Service"), operated by the individual identified in the Legal Notice ("we", "us", or "our"). By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, please discontinue use immediately.

2. Eligibility

The Service is intended for users aged 13 years and older. If you are under the age of 16 (or such higher age required for consent to data processing in your country), you must have obtained verifiable parental or guardian consent prior to using the Service. By using the Service, you represent that you meet these age requirements.

3. Nature of the Service

Kukuruchi is a free-to-play browser-based strategy simulation game. No purchase, registration, or download is required to play. The game is provided "as is" for entertainment purposes. All in-game progress, assets, and credits are virtual and have no monetary value. We do not sell virtual items or currencies.

4. Intellectual Property

All intellectual property rights in the Service — including but not limited to game design, source code, graphics, texts, names, and logic — belong to the operator. You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your personal, non-commercial enjoyment only. You may not copy, reproduce, modify, distribute, sell, or exploit any part of the Service without our prior written consent.

5. Prohibited Conduct

You agree not to:

We reserve the right to restrict access for users who violate these rules.

6. Availability and Modifications

We strive to maintain continuous availability of the Service but do not guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice, for maintenance, technical, legal, or commercial reasons. We shall not be liable to you or any third party for any such modification, suspension, or discontinuation.

7. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We make no warranty that the Service will meet your requirements or be error-free.

8. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data or game progress, arising from your use of the Service. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be limited by law.

9. Data Protection

Data processing is governed by our Privacy Policy and Cookie Policy, both of which form an integral part of these Terms.

10. Governing Law and Jurisdiction

These Terms are governed by the law of the Federal Republic of Germany. Any disputes shall be subject to the exclusive jurisdiction of the competent courts in the operator's place of residence, to the extent permitted by applicable law. If you are a consumer resident in the EU, you also retain the right to bring proceedings in the courts of the country in which you reside.

The European Commission provides an online dispute resolution (ODR) platform at ec.europa.eu/consumers/odr. We are not obliged to participate in dispute resolution proceedings before a consumer arbitration board and do not currently do so.

11. Changes to These Terms

We may update these Terms from time to time. The current version is always available at this URL. Continued use of the Service after any changes constitutes your acceptance of the revised Terms.

12. Severability

If any provision of these Terms is held by a competent court to be invalid or unenforceable, the remaining provisions shall remain in full force and effect, and the invalid provision shall be replaced by a valid provision that comes closest to the original intent.
